Terms of Service

1. Acceptance of terms

By creating an account or using Contrack ("the Service") you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. If you use the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of service

Contrack provides field-service management software for tradespeople, including tools for quoting, job management, scheduling, invoicing, and customer management. The Service is provided on a subscription basis.

3. Account registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised access at support@contrack.ie.

4. Subscription and payment

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. Prices may change with 30 days' notice. Failure to pay may result in suspension or termination of your account.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to other accounts or systems
• Transmit malware, spam, or any content that infringes third-party rights
• Reverse-engineer, decompile, or create derivative works from the Service
• Resell or sublicence access to the Service without our written consent

6. Your content

You retain ownership of all data you upload to the Service ("Your Content"). By uploading Your Content you grant Contrack a limited licence to store, process, and display it solely to provide the Service to you. We will not share Your Content with third parties except as necessary to operate the Service or as required by law.

7. Data processing

Where Contrack processes personal data on your behalf as a data processor, the terms of our Data Processing Agreement apply. By accepting these Terms you also accept the Data Processing Agreement.

8. Intellectual property

Contrack and its licensors own all intellectual property rights in the Service, including its software, design, and content. Nothing in these Terms transfers any intellectual property rights to you.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Contrack's total liability to you shall not exceed the greater of (a) the fees paid by you in the 12 months preceding the claim, or (b) €100. We shall not be liable for indirect, incidental, or consequential damages.

11. Termination

You may cancel your subscription at any time from the billing settings. We may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your data will be retained for 90 days before permanent deletion, giving you time to export your records.

12. Governing law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
